1. Overview
This Acceptable Use Policy ("AUP") is part of the Luminous Social Terms of Service (https://luminoussocial.com/legal/terms) and applies to everyone who accesses the Service, including team members you invite. Capitalized terms have the meanings given in the Terms. If you violate this AUP, we may suspend or terminate your access.
2. Illegal or Harmful Use
You may not use the Service to:
- Violate any applicable law or regulation, including consumer protection, privacy, advertising, competition, and export-control laws of Canada, the United States, or any other jurisdiction that applies to you.
- Infringe intellectual property, privacy, publicity, or other rights of any person.
- Promote or facilitate illegal products or activities, fraud, phishing, or scams.
- Harass, threaten, or defame any person, or publish hateful, violent, or sexually exploitative content.
- Process personal information about others without a lawful basis, required notices, and any required consents.
3. Security and Integrity
You may not:
- Probe, scan, or test the vulnerability of the Service, or breach or circumvent authentication, access controls, or plan limits.
- Upload malware or other harmful code, or interfere with the Service, its infrastructure, or other users.
- Scrape, crawl, or bulk-extract data from the Service except through features we provide.
- Share account credentials, sell or transfer access, or use another person’s account without permission.
- Reverse engineer the Service except to the extent a law expressly permits it despite this restriction.
4. Messaging, Email, and Anti-Spam (CASL / CAN-SPAM)
If you use the Service (including connected email or marketing platforms such as Klaviyo, Mailchimp, or HubSpot) to send commercial electronic messages, you are responsible for complying with all anti-spam laws that apply to your recipients, including Canada’s Anti-Spam Legislation (CASL) and the U.S. CAN-SPAM Act.
- Send commercial messages only to recipients from whom you have valid express or implied consent (where consent is required).
- Identify yourself (or your client) accurately as the sender and include valid contact information.
- Include a functioning unsubscribe mechanism and honor unsubscribe requests promptly (within 10 business days under CASL).
- Do not use harvested lists, purchased lists without valid consent, or misleading subject lines or headers.
5. Content and Advertising Standards
Content you create, schedule, or publish through the Service (including AI-assisted content) must be truthful and not misleading, and must comply with applicable advertising and marketing laws, including the Competition Act (Canada), the BC Business Practices and Consumer Protection Act’s prohibitions on deceptive acts and practices, and U.S. FTC rules (including endorsement, testimonial, and disclosure requirements).
- Do not publish fake reviews or undisclosed paid endorsements.
- Do not make unsubstantiated performance, health, or earnings claims.
- Include disclosures required for sponsored or affiliate content.
- Comply with the advertising and community policies of each platform you publish to (Meta, TikTok, Google, LinkedIn, Snapchat, and others).
6. AI Features
When using AI features, you may not:
- Generate unlawful, deceptive, or harmful content, or content that impersonates real people without consent.
- Represent AI output as human-created where a law or platform policy requires disclosure.
- Submit sensitive personal data to AI features unless necessary, lawful, and permitted by your client agreements.
- Use AI features to make automated decisions with legal or similarly significant effects on individuals.
8. Enforcement and Reporting
We may investigate suspected violations and may remove content, suspend features, or suspend or terminate accounts—without notice where reasonably necessary to protect the Service, other users, or third parties, or to comply with law or platform requirements.
